Terms & Conditions

A. General

1. By accessing our site and placing an order you agree to be bound by these terms and conditions and our terms of use policy. The text below provides the terms and conditions on which the supply any of our curated meals specified by you and supplied by our partner kitchens. Our Partner Kitchen is not a traditional restaurant or dining-in facility. It is an operational kitchen owned by a third party for the preparation of food that functions as a production unit based on curated or designed menus by the customer jointly with India Secret Kitchen (“Partner Kitchen”).

2. Delivery and catering of the food to the customer will be executed by the Partner Kitchen or such transport company that may be convenient at the time.

3. India Secret Kitchen is a business where the food is curated as per your needs and is prepared by vetted independent kitchens and chefs i.e. our Partner Kitchens and delivered by us or the respective Partner Kitchen.

4. Pictures of food items (“Menu”) listed on our site are for illustrative purposes only. A discrepancy in the final menu items delivered, can be due to differences in pixelation of screens, and/or technological variance that results in optical differences as illustrated on our website.

5. The Menu and the price on the Menu are based on the seasonality of items and supply and will be subject to change at our sole discretion.

6. Specialised meals beyond our suggested menus designed out of our suggested menus and cuisines with our Chef(s) will bear the same terms and conditions. Your choice of food may be based on the suggested or available menu(s). A more eclectic and bespoke menu may also be finalised with our in-house Master Chef.

7. India Secret Kitchen will finalise orders on our vetted Partner Kitchens on your behalf and will deliver the meals at the location specified by you.

B. Service Availability

1. The client shall specifically provide the name of the prescribed delivery area with a landmark and its Google pin location.

2. The selection of the Partner Kitchen and Partner Chef will be at the sole discretion of India Secret Kitchen and the food will be served in the best condition as per your needs and the schedule as discussed.

3. If you live outside the deliverable areas, a message will appear on your screen notifying you that delivery may not be possible.

4. We do not accept orders from an area in which we do not have a vetted Partner Kitchen.

5. Operating hours will vary depending on local conditions and the availability of our Partner Kitchens.

C. Orders

1. After finalising the cuisine as per the discussion and the number of meals, an email will be sent to you as a confirmation from which your final invoice will be generated.

2. Please ensure that you have provided us with the correct address, telephone number and email address for the purposes of verified communication and for the meals to arrive on time and at the accurate location.

3. If you do not open the door or respond to telephonic correspondence within 30 minutes of our delivery drivers physically reaching your address, we reserve the right to leave the premises, and you will be charged fully for the Order.

4. We monitor our Partner Restaurants and Chefs very closely and it is of utmost importance to us that they comply with our highest standards.

5. If there is any modification in any placed orders, the same shall be communicated to India Secret Kitchen 48 hours prior to delivery via email or the contact details you provide.

6. All the above Terms and Conditions will be held null and void and India Secret Kitchen will not be responsible if the user contacts the Kitchen or chef or by any third party channel and claims any mismatch with the order after the delivery.

D. Cancellation

1. You have the right to cancel an order 48 hours prior to the delivery. If there is any cancellation 24 hours prior to delivery, 50 % of the total order value will be retained by the India Secret Kitchen.

2. We will classify a bad order as any order which is cancelled after food has been used to start preparing.

3. An order is considered a “Confirmed Order” when an advance has been received.

4. If an order is confirmed, an invoice will be emailed to you and generated by our internal system.

5. Customers can cancel an order only by email.

6. You will not be charged for any orders cancelled 48 hours before in accordance with this clause.

7. Any order cancelled within 24 hours of delivery will be fully chargeable.

8. India Secret Kitchen will determine whether an order is Confirmed or not.

E. Price and Payment Terms

1. The price of any meal will be finalised based on mutually agreed terms.

2. The prices on the Menu will change and shall only be valid for 48 hours as communicated via our “Estimation Email”.

3. Prices will change at any time, but the changes will not affect orders in respect of which you have been presented with the confirmation email, save in the case of an obvious pricing mistake, whereby we will notify you as soon as we can about the pricing issue.

4. You may be able to cancel your order once we notify you.

5. Our Master Chef will normally ratify prices as part of the ordering process.

6. Balance due for all “Confirmed Orders” will be made by cash on delivery, debit card, UPI or through our payment link 6 hours before delivery.

7. Once your order has been confirmed your credit or debit card will be authorized and the amount marked will be invoiced and marked for payment.

8. We are authorized by our partner kitchens to accept payment on their behalf and payment of the price of any meals to us will discharge your obligations to pay such price to the Partner Kitchen.

9. Kindly communicate to the Indian Secret Kitchen, 48 hours in advance through email for cancellation or postponement of the order.

10. 75% of the payment shall be made in advance, at the time of order placement for the confirmation and the balance can be paid when the food arrives at your premises. The advance money will be refunded in 2-3 working days if food and service are cancelled before three (3) days and two (2) % will be retained as a convenience charge. All the regulatory taxes like GST would be applicable.

F. Our Liability

To the extent permitted by law, IndiaSecretKitchen.com provides our service and content on an "as-is" and "as-available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of our Service, or that it will be timely or error-free or that defects will be corrected. Subject as provided below, neither IndiaSecretKitchen.com nor any Partner Kitchen shall have any liability to you for any direct, indirect, special, or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from your use of or your inability to use our Service. In the event that IndiaSecretKitchen.com or the Partner Kitchen is found to be liable to you our total aggregate liability is limited to 50% of the purchase price of the meals, you have paid for in your order. This does not include or limit in any way IndiaSecretKitchen.com or any of our Partner Kitchens’ liability for any matter for which it would be illegal for us or it to exclude, or attempt to exclude, our or its liability, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.

G. Force Majeure

No party shall be liable to the other for any delay or non-performance of its obligations under these terms arising from any cause beyond its control including, without limitation, any of the following: acts of God, governmental act, war, Pandemic, epidemic, fire, flood, explosion or civil commotion. For the avoidance of doubt, nothing in this clause shall excuse the customer from any payment obligations under these Terms and Conditions.

H. Our right to vary these terms and conditions

India Secret Kitchen may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.

I. Law and Jurisdiction

All the terms shall be governed by and construed in accordance with the laws of India, without giving effect to any choice of law or conflict of law provisions. Any dispute, controversy or claim arising out of or in connection with these terms shall be sought to be resolved and settled amicably within 30 (thirty) days of such dispute arising, failing which it shall be referred to and shall be finally settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996 or any modification thereto/re-enactment thereof. A sole arbitrator shall be appointed by the Terms and Conditions of the parties. The seat of Arbitration shall be Bangalore and the language used shall be English. Any arbitration award shall be final and binding and may, if necessary, be enforced by any court(s) in Bangalore. The Parties undertake and agree that all arbitral proceedings conducted with reference to this arbitration article will be kept strictly confidential, and all information, documentation, and materials in whatever form disclosed in the course of the proceedings shall be used solely for the purpose of those proceedings.
